2020年8月2日，杨某、周某、魏某等人在未办理出入境手续的情况下，从湖北钟祥出发前往云南昆明，再由昆明乘坐飞机到达云南沧源县，在境内外“蛇头”的安排下，辗转坐车、爬山几小时，于8月3日偷渡到缅甸境内。

到达缅甸次日，“华哥”便为偷渡来的几人安排了“工作”。有两人被安排专门从事电信诈骗，使用“杀猪盘”套路诱骗他人在诈骗公司制定的赌博网页上赌博，待他人充值后再将钱骗走。有三人在赌场上班，从事开车、放码等工作。还有两人在赌场输光自己带来的几万元钱后，去KTV当起了服务员。

在缅甸工作期间，他们和其他偷渡的人居住在拥挤的宿舍，手机也被没收，禁止与外界联系，还时常受到“关水牢”的威胁，想要离开就必须将之前偷渡过来的路费还上。几人没有收入，便只好继续留下打工。

由于缅甸疫情严重，治安条件差，加上经常看到身边有人被殴打致伤，几人都不敢在缅甸待了，纷纷动起了回家的念头。有的人还清赌场的钱后离开，有的则偷偷跑出来，通过当地“蛇头”将自己带到边境后，向国内边防口岸投案。缴纳罚款后，回到了家乡钟祥。

检方意见
案件移送至钟祥市检察院后，承办检察官审查后认为，犯罪嫌疑人杨某、周某、魏某、陈某等人违反边境管理法规，结伙偷越国（边）境，其行为触犯了《中华人民共和国刑法》第三百二十二条，犯罪事实清楚，证据确实、充分，应当以偷越国（边）境罪追究其刑事责任。

检察官认为，本案法定刑为一年以下有期徒刑、拘役或者管制，并处罚金。七名犯罪嫌疑人均认罪认罚，周某、魏某、陈某系想通过偷渡到境外挣钱，且初次，可在拘役量刑，并处罚金，可处缓刑。杨某在偷越国（边）境中作用较大，系犯意的提议者，应在有期徒刑量刑，并处罚金。

2021年3月，杨某伙同十余人企图偷渡，在云南被钟祥市公安局劝返，应认定为犯罪未遂，杨某作为结伙偷渡边境的提议者，应依法追究其刑事责任，其他参与者系初次，且为犯罪未遂，在公安民警的规劝下，主动放弃犯罪，可认定为犯罪情节显著轻微，不以犯罪论，建议公安机关予以教育、训戒。
